These Terms of Service ("Terms") govern your use of the Wylas Timing website (wylas-timing.com), our wireless swim timing systems, proprietary software, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website or purchasing and using our timing systems and software, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

2. Description of Services

Wylas Timing provides:

  • Wireless swim timing hardware (stopwatches, scoreboard adapters, touchpad adapters, start systems)
  • Wylas Recorder proprietary timing software (licensed per swim season)
  • Meet manager integration adapters (Hytek Meet Manager, SwimTopia Meet Maestro, Splash Meet Manager)
  • Swimming scoreboard solutions (WiFi and Ethernet adapters)
  • Technical support and customer service

3. User Accounts

To access certain features of our Services, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Software License

The Wylas Recorder software is licensed, not sold. Upon purchasing a software license, you are granted a non-exclusive, non-transferable, limited license to use the software for the duration of your subscription period (six, nine, or twelve months). You may not:

  • Copy, modify, or distribute the software
  • Reverse engineer, decompile, or disassemble the software
  • Sublicense, rent, or lease the software to third parties
  • Use the software for purposes other than swim timing operations
  • Remove or alter any proprietary notices or labels

5. Hardware Purchases

All hardware purchases are subject to our pricing, shipping, and return policies. Hardware components include wireless stopwatches, scoreboard adapters, touchpad adapters (Beamatouch), start systems (Wylas Trinity), WiFi routers, and storage cases. Pricing is dependent on lane configuration, watch count, and additional hardware selections.

6. Payment Terms

Hardware components are purchased upfront. Software licenses are billed per swim season. All prices are quoted in the applicable currency at the time of purchase. Payment is due upon order unless otherwise agreed in writing.

7. Warranty & Support

Wylas Timing hardware is warranted against defects in materials and workmanship for a period as specified at the time of purchase. This warranty does not cover damage caused by misuse, accident, modification, or normal wear and tear. Technical support is available through our support portal at help.wylas-timing.com.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Wylas Timing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use our Services. Our total liability for any claims arising under these Terms shall not exceed the amount you paid for the specific product or service giving rise to the claim.

9. Third-Party Integrations

Our Services may integrate with third-party products and services, including Hytek Meet Manager, SwimTopia Meet Maestro, Splash Meet Manager, Colorado Time Systems hardware, OMEGA/Swiss Timing touchpads, and Macsha touchpads. These integrations are provided "as is" and we are not responsible for the functionality, availability, or terms of these third-party products.

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Wylas Timing and is protected by applicable intellectual property laws. You may not use, reproduce, or distribute any content from our website without our prior written permission.

11. Data & Timing Results

Timing data, race results, and meet information generated through our system remain your property. You are responsible for backing up your data. Wylas Timing is not responsible for any loss of timing data due to hardware failure, software issues, or user error.

12. Acceptable Use

You agree not to:

  • Use our Services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the operation of our Services
  • Use automated means to access our website without our permission
  • Misrepresent your affiliation with any person or organization

13. Termination

We may suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Upon termination, your right to use our software will immediately cease.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after any changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Wylas Timing is registered, without regard to conflict of law principles.
